This agreement is between you and Ardeshir Saadatnejadi ("we", "us"), and governs your use of the rivnode desktop application and any content packs we supply ("the Software"). By installing or using the Software you accept these terms. If you do not accept them, do not install or use it.
You are buying a licence to use the Software. You are not buying the Software itself; we retain all intellectual property rights in it.
The licence is perpetual. Once purchased, you may keep using the versions of the Software covered by your licence indefinitely, with no further payment and no requirement to remain connected to the internet.
Your purchase includes twelve months, from the date of purchase, of: application updates, content-pack downloads, and access to the optional AI assistant. When those twelve months end, the version you have installed keeps working exactly as it is. New updates, new content packs and the assistant become unavailable until you purchase a further period. We will not disable, expire or remove software you have already installed.
You may install and use the Software on up to three machines that you own or control, and use it at the same time on those machines. Licence keys are personal to you.
You may not share, resell, sublicense, rent, publish or transfer your licence key, or distribute the installer to anyone else. You may not attempt to circumvent the licensing mechanism, and you may not decompile, disassemble or reverse engineer the Software except where that right cannot lawfully be excluded.
The Software is study software, designed to be used away from the table on hands that have already been played. It has no capability to assist you during play: it does not run against a live game, does not overlay or attach to any poker client, and cannot take an action on your behalf.
You must not use the Software, or any output from it, as real-time assistance during a hand you are playing. You must not attempt to modify or extend it for that purpose.
You are responsible for complying with the terms of service of any poker platform you use, and with the law in your jurisdiction. Permitted software varies between operators and it is your responsibility to check. Nothing in this agreement should be read as a representation by us that the Software is permitted on any particular platform.
Solver features require PioSolver, a separate commercial product that you must obtain and licence yourself. We do not supply, bundle, resell or support PioSolver, and we are not affiliated with its authors.
The optional AI assistant uses an API key that you supply from a third-party model provider. Requests travel directly from your machine to that provider under your own account and their terms. We do not resell, proxy or mark up that service.
Hand histories and analysis results stay on your machine. We do not receive, collect or store them. See the privacy policy for what we do hold, which is limited to what licensing requires.
Content packs we supply contain anonymised statistical aggregates only. You may use them within the Software for your own study. You may not extract, redistribute, resell or publish them, in whole or in part.
You must be at least 18 years old, or the age of majority where you live if that is higher, to purchase or use the Software.
This licence ends automatically if you materially breach it — in particular if you share or resell your key, or use the Software for real-time assistance. We may also revoke a licence key where the corresponding payment has been reversed, charged back or refunded.
On termination you must stop using the Software and remove it from your machines.
The Software is provided "as is". We do not warrant that it will be free of errors, that it will run without interruption, or that its analysis is suitable for any particular purpose.
The Software is an analysis tool, not advice. Its output is a model of a game. Poker involves risk and variance, and nothing produced by the Software is a prediction of, or a guarantee about, results. Decisions you make with it are yours.
To the fullest extent permitted by law, our total liability arising from this agreement is limited to the amount you paid for the licence. We are not liable for indirect or consequential loss, including lost profits or lost data. Nothing here limits liability that cannot lawfully be limited.
Purchases are processed by Polar as merchant of record. Polar handles payment, invoicing and applicable sales tax or VAT, and its terms apply to the transaction itself. Refunds are covered in our refund policy.
We may revise this agreement for future releases. The version you accepted at purchase continues to govern the versions covered by your licence at that time; a revised version applies if you install software released under it.
This agreement is governed by the laws of the Province of Quebec, Canada. If you are a consumer, this does not deprive you of the protection of mandatory consumer law where you live.
